Is your trust charitable?

Is your trust dedicated to charitable goals? Does it provide public benefit, which could include relief to those in poverty, the promotion of education or of religion, or providing a benefit to animals or to a public location? If you can say yes to both questions, then you have a charitable trust. There are advantages to being a charitable trust.

The biggest benefit is that charitable status provides exception from several forms of tax, including income tax, corporation tax, capital gains tax and council tax. They also have freedoms not found in other types of trust, as a special definition of trustee is used that means no individual beneficiaries are identified in a charitable trust, meaning that the trustees have far wider-ranging powers regulated only by the Charity Commission.
